Federal Policy Announcements and the Child Welfare Policy Manual


Child Welfare Policy Manual

PIQs and PAs were policy documents issued periodically by the U.S. Department of Health and Human Services, Administration for Children and Families, Children's Bureau in response to questions from state agencies. The federal Children's Bureau is in the process of replacing these individual issuances with a Child Welfare Policy Manual. The manual uses parts of PA-01-01 and other previous federal issuances to address particular issues.

Except for the one recently corrected section pertaining to children who come into the care of private agencies via voluntary agreements, PA-01-01 is still an active federal policy document and may be cited as an authoritative policy source by parents and advocates. The Child Welfare Policy Manual is written in a question and answer format and incorporates sections of PA-01-01 and other federal policy issuances to address specific issues. Ideally, parents and advocates should cite the pertinent section of the Child Welfare Manual and PA-01-01 or other document which is listed the source of the answer. In cases, where the manual does not address the issue at hand, but PA-01-01 does, using PA-01-01 will suffice.

In October 2001, a Letter from Tommy Thompson, Secretary U.S. Department of Health and Human Services to Senator Mike DeWine, Ohio pledged to amend the section of PA-01-01 pertaining to the eligibility of children for Title IV-E adoption assistance who come into the care of private agencies through voluntary agreement and are subsequently placed for adoption. On November 6, 2001, the Children's Bureau issued an Information Memorandum, ACYF-CB-IM 01-08, announcing the amendment promised by Secretary Thompson and stipulated that the new policy "should be followed as having been continuously in effect with no break." IM-01-08 further noted the states "must enter into an adoption assistance agreement with the family" in any case where a child adopted after February 18, 2000 had been denied adoption assistance, but would have been eligible under the revised policy. The new policy was to be inserted in Section 8.2B.13 of the Child Welfare Policy Manual. dealing with eligibility provisions.
